Terms of Use

Plain terms for a site with nothing to hide.

These Terms govern your use of aethel.click. They are written to be read, not to obscure obligations. If something is unclear, contact us.

Effective date: 9 May 2025

Acceptance

Agreement by use

By accessing aethel.click or submitting any form on this site, you agree to these Terms. If you do not agree, do not use the site.

Capacity

You represent that you are at least 16 years of age and have the legal capacity to enter into a binding agreement in your jurisdiction. If you are using the site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Relationship to the Privacy Policy

These Terms incorporate the Privacy Policy by reference. Where the two documents address the same subject, both apply. In the event of conflict, the more specific provision governs.

The Site

Nature of the site

Aethel is a pre-launch marketing and waitlist site for a product currently in development. No AI learning companion is available for use at this time. The site provides information about the planned product, a waitlist form, a blog, and a contact form.

No guarantee of launch

Joining the waitlist does not guarantee access to the product, a launch date, or that the product will be built as described. Product scope, features, and timeline are subject to change without notice.

No professional advice

Nothing on this site constitutes legal, financial, medical, psychological, or any other form of professional advice. Blog posts are editorial in nature. Reliance on any content is at your own risk.

Permitted Use

Personal, non-commercial use

You may access the site for personal, informational, and non-commercial purposes. You may share links to pages and quote brief excerpts from blog posts with attribution.

Waitlist and contact forms

You may submit to the waitlist and contact forms using accurate information that represents you or your organisation. Each form carries rate limits stated in the Privacy Policy. Circumventing those limits is a prohibited use.

Blog content

Blog posts are published for reading and reference. You may link to any post. You may quote up to 150 words of any post for commentary, criticism, or news reporting, provided attribution and a link to the original are included.

Prohibited Use

Automated access

Scraping, crawling, spidering, or otherwise extracting content or data from this site by automated means, except by search engine bots operating in accordance with our robots.txt, is prohibited.

Abuse of endpoints

Sending requests to any API endpoint at a volume or frequency that circumvents rate limiting, causes service degradation, or constitutes a denial-of-service attack is prohibited.

Fraudulent submissions

Submitting false or misleading information to the waitlist or contact form, submitting on behalf of another person without their consent, or using the contact form to send unsolicited commercial communications is prohibited.

Interference

Attempting to gain unauthorised access to any part of the site, its infrastructure, or its data; injecting malicious code; or interfering with the integrity or performance of the site is prohibited and may constitute a criminal offence.

Reproduction

Reproducing, republishing, or redistributing the site's written content, design, or source code beyond the permissions stated in the Permitted Use section above is prohibited without prior written consent.

Intellectual Property

Ownership

All content on this site — including but not limited to text, design, visual identity, the Aethel name and mark, and original source code — is owned by or licensed to the Aethel team and is protected by applicable intellectual property law.

Open source components

The site is built on open-source software including Next.js, Prisma, Tailwind CSS, and others. Each is used under its respective licence. These Terms do not alter or supersede those licences.

Feedback

If you submit suggestions, ideas, or feedback about the product or site via the contact form or any other channel, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback in any way without obligation to you.

Disclaimers

Provided as-is

The site is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Content accuracy

We make reasonable efforts to ensure accuracy, but we do not warrant that any information on the site is complete, current, or free of error. Blog posts reflect the views of their authors at the time of publication.

Product descriptions

Descriptions of the Aethel product — its features, philosophy, and architecture — are aspirational statements about a product in development. They do not constitute representations about a released product and are subject to change.

Limitation of Liability

Exclusion of indirect damages

To the fullest extent permitted by applicable law, the Aethel team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the site, even if we have been advised of the possibility of such damages.

Cap on direct liability

Our total liability to you for any claim arising from your use of this site shall not exceed the greater of the amount you paid us in the twelve months preceding the claim (which is zero for all current users) or €100.

Jurisdictional exceptions

Some jurisdictions do not permit exclusion of certain warranties or limitation of certain liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Third-Party Services

External links

The site may contain links to third-party websites. We do not control, endorse, or accept responsibility for any third-party content. Visiting a linked site is at your own risk and subject to that site's own terms.

Google AdSense

Advertising units served by Google AdSense are subject to Google's terms of service and privacy policy. We are not responsible for the content of advertisements displayed on the site.

Infrastructure providers

The site runs on infrastructure provided by Supabase, Upstash, and Vercel. Outages, data incidents, or service limitations attributable to those providers are beyond our control. We are not liable for consequences arising from such events.

Changes to Terms

Right to modify

We reserve the right to modify these Terms at any time. Material changes will be announced via a blog post, and the effective date at the top of this page will be updated.

Continued use

Continued use of the site after a change becomes effective constitutes acceptance of the revised Terms. If you disagree with a change, your remedy is to stop using the site.

Governing Law

Applicable law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Aethel team is domiciled, without regard to conflict of law principles.

Dispute resolution

We prefer to resolve disputes informally. Before initiating any legal proceeding, please contact us at the address below and allow fourteen days for a response. This does not waive any right to legal recourse.
